Fair Chance Hiring
On Feb. 27, 2024, the Los Angeles County Board of Supervisors adopted the Fair Chance Ordinance for Employers to provide equitable protections for individuals with criminal history seeking opportunities for gainful employment. An employer must engage in the Fair Chance process when adverse actions are taken based on the review of criminal history. This includes an employer’s withdrawal of a conditional job offer, and may include any employer decisions such as promotions, reassignment, discipline, and termination.
The Fair Chance Ordinance for Employers is effective September 3, 2024
L.A. County Required Workplace Posting
Every employer shall post, in a conspicuous place at any workplace or jobsite within unincorporated areas of the County of Los Angeles where any worker works, a notice informing workers of their rights under the Fair Chance Ordinance for Employers.

Are employers required to conduct background checks on their applicants or employees?
No, The Fair Chance Ordinance for employers does not mandate employers to conduct background checks. If an employer chooses to, and bases their hiring decisions on those reports, they must follow the Fair Chance Process when withdrawing a conditional job offer.
Does the ordinance apply to all of Los Angeles County?
The ordinance applies to any employer with five or more employees, regardless of location, whenever they are seeking to hire or are currently employing persons who perform at least two hours of work on average each week within the unincorporated areas of Los Angeles County. - Inquired about the applicant’s criminal history during the interview process before offering a conditional job offer
- Failed to provide a Notice of Intent
- Never contacted the applicant after reviewing their criminal history
- Is considering arrests or other non-convictions
- Failed to make a connection between the job duties and convictions.
